  1. Information About Us

Education for Sustainability CLG is a non- profit social enterprise aimed at increasing climate literacy and fostering behaviour change in Ireland. We execute a variety of educational programmes such as workshops, teacher training and a 10-week climate literacy course for 6th class up to transition year. It is our vision to create a world where young people are actively engaged in taking action for sustainable development by making environmental education and sustainability a fundamental part of the national curriculum.   1. Introduction

These are the Terms and Conditions governing use of this website educationforsustainability.ie and of our delivered education services, and the agreement that operates between us and you (the “Terms”). This website is owned and operated by Education for Sustainability CLG (“EFS”).   These terms set out the rights and obligations of all users (“you”/”your”) in relation to your use of the website and interaction with EFS either face to face or via our portal. Please carefully read these Terms. By accessing this website & portal, and by agreeing to avail of our educational services you agree to be bound by these Terms, including the EFS Privacy Policy & the EFS Cookie Policy. If you do not agree to be bound by these Terms you should not access or view this website. By using any of our services (even just browsing our website), you’re agreeing to the Terms. If you do not agree with the Terms, the legal binding contract between you and EFS, you may not use our Services.  We reserve the right to change and/or amend any or all terms or conditions at any time.

 

  1. Courses

There are currently 5 courses that you can sign up to as follows:

  1. 10-week Climate Literacy Program for schools
  2. Sustainability Action Workshops
  3. Plastic-Free School Program
  4. Teacher Training Program
  5. Employee Training Program

You are responsible for ensuring you are at the right level of learning to benefit from the CPD qualifications and before committing to teach children with this subject matter. The following terms apply to any council or school who books and of our courses listed above in section 3:

Course programmes must be completed within a 1-year period from the commencement of the first course unit. *If your studies run for over 12 months, you will be required to purchase additional workshops to ensure access to the portal remains in place. You are responsible for keeping your membership paid and up to date. 

All fees shown on our website are exclusive of VAT as EFS is not obliged to charge VAT as part of delivering these services.? (Not sure this is correct, delete if not).

 

4. Registration for courses

When registering for any of the available courses, either directly for a school, or indirectly on behalf of a school, or group of school’s payment can be made in full upfront by credit card, bank transfer, or by paying an initial 50% upfront, with the balance to follow within 30 days.

We reserve the right to refuse any course booking.

Your course will be scheduled once a purchase order has been sent, invoice received, and initial payment sent to EDS.   Failure to make payments in this timeframe will result in the school being withdrawn from the programme. All fees paid up to this point are non-refundable and non-transferable. 

The license length for schools to access EFS course content is 12 months from date of payment received.  Once the school has completed the course, online access for staff is available to our content made available on our “My Quest” portal for 12 months for the teachers to keep up to date with relevant content to allow them utilise during their classes.  Permission is granted only for this purpose, and utilising this content for anything other than this purpose is not permitted without prior permission from EFS.   The information provided on our website is for general climate & sustainability information purposes only. It is not and should not be construed as financial, professional or other advice. We strongly caution you to not solely rely on the information you find here to inform your decisions; rather, use it as a starting point for doing your own independent research.

Our website is for your non-commercial, educational use only and not for business purposes other than as designed.

Refunds & Termination 

  1. Refunds: If a refund is requested in writing within 14 days following receipt of your order confirmation, then a Service and Administrative charge of €50 will be deducted from the refund due. Refunds are issued to the card from which the programme fees were taken. Once the Program has been commenced by a school, this is an indication of use of service and express acceptance of the above terms and conditions, and as a result no refunds will be issued at that point. This applies to registration of any course listed above.
  2. Termination: On failure of your agreed final instalment payment, we will attempt to charge your card a further 3 times. On failure of the fourth attempt, we will proceed to cancel your order and you will no longer have access to our services. Service will only be reinstated on payment of remaining annual balance upfront.  Failure to meet any agreed payment dates within the specified timeframes will result in the school being withdrawn from the programme and access to the EFS systems being revoked. All fees paid up to this point are non-refundable and non-transferable. 

 

  1. Billing 

You may be asked to provide a credit or debit card number from a card issuer that we accept in order to activate your instalments – your authorisations in this section also apply to our payment processor and any other company who acts as a billing agent for us. You hereby authorise us to charge your specified payment method on a monthly basis, in advance, for recurring payment instalments, and to charge in advance for any course based or other payment models, and/or to place a hold on your payment method with respect to any unpaid charges for instalments. You authorise the issuer of your selected payment method to pay any amounts described herein without requiring a signed receipt. You authorize us to continue to attempt to charge and/or place holds with respect to all sums described herein, or any portion thereof, to your payment method until such amounts are paid in full. You agree to provide updated payment information upon request and any time the information you previously provided is no longer valid. You acknowledge and agree that EFS will not have any liability whatsoever for any insufficient funds or other charges incurred by you as a result of attempts to charge, and/or place holds on, your specified payment method as contemplated by these Terms. 

You agree to pay us, through our payment processors, all charges at the prices then in effect for any purchase in accordance with the applicable payment terms presented to you at the time of purchase. You agree to make payment using the payment method you provide when you sign up for a course. We reserve the right to correct, or to instruct our payment processor or financing partner to correct, any errors or mistakes, even if payment has already been requested or received. 

We use Stripe.com to process single and recurring payments for plans. In this case, your card is securely stored with Stripe.com and future transactions are scheduled through Stripe Billing. This process keeps all our customer data secure and allows you to take advantage of our 50% / 50% dual  payment plan. 

 

  1. Accessing Our Site & Portal

Access to our website, courses and portal is granted in accordance with your course selection and in accordance with our Terms and Conditions.  We reserve the right to withdraw or amend the service we provide on our website, courses or portal without notice. We will not be liable if for any reason our website or portal is unavailable at any time or for any period. Where necessary and agreed with specific users we can adopt special conditions regarding the accessibility of our site.

If you are in breach of these Terms, EFS may as its option, suspend your access to this website and portal and refuse to provide you with any further access to it.

 

  1. Intellectual Property Rights

We are the owner or the licensee of all intellectual property rights in our website (except where specifically identified as third-party content), and in the material published on it and used by use during the implementation of our courses. Those works are protected by applicable intellectual property and other laws around the world. All such rights are reserved.

In respect of all material that you submit to or post on our website, including social media posts and photos taken during course implementation, you grant to us a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate and distribute such material in any media, together with the right to sub-license such rights solely for the purposes of the services provided on the website.

We grant customers/ learners a limited licence solely to upload and/or view the content posted by contributors and for no other purposes.

You may print off one copy, and may download extracts, of any page(s) from our website only when you are specifically invited to or as required to use such and you may draw the attention of others within your organisation to material posted on our website.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of material on our website must always be acknowledged.

You must not use any part of the materials on our website or provided during the implementation of a course for any commercial purposes without obtaining a licence to do so from us or our licensors.

If you print off, copy or download any part of our site in breach of these Terms, your right to use our website and portal will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

 

  1. Use by Minors and User Identity

The use of our website by minors under the age of 16 is subject to the consent of their parent or guardian. We advise parents, guardians or other responsible adults who permit children to use the internet that it is important that they communicate with children about their safety online.

It is impossible for us to determine with any degree of certainty whether any user is in fact the person he or she represents to be. Accordingly, we accept no liability for the actual identity of any user. You are solely responsible for verifying the actual identity of other users.

 

  1. Our Website and Our Terms Change Regularly

We aim to update our website regularly, and may change the content at any time without notice. If the need arises, we may suspend access to our website or portal, or close it indefinitely. Any of the material on our website or portal may be out of date at any given time, and we are under no obligation to update such material.

We may amend these Terms from time to time. Each time you use our website or portal you will be bound by the then current Terms, our Privacy Statement and our Cookie Policy and you should review these each time you access and use our website to satisfy yourself that you are happy with them. 

 

  1. Reliance on Information Posted

Information, content, commentary and other materials posted on our site or portal are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our site, or by anyone who may be informed of any of its contents.

While EFS has made all reasonable efforts to ensure that the information on this website and portal was correct at the time of inclusion, you should be aware that EFS accepts no responsibility if the information is incomplete, inaccurate or out of date.

Except as expressly provided for on this website, EFS is not responsible for the content or use of any web pages or any messages sent or received by you.

You agree to be accurate and/or genuine in any comments you leave on any EFS content and social media channels or when you participate in an EFS discussion forum or chat room.

 

  1. Our Liability

Every care is taken to ensure the advice and education provided by EFS, its associates and staff is accurate, no liability can be accepted for any loss, damage or other expense incurred from such advice. EFS reserves the right to deny final submission of teachers’ work to assessment boards from a Continuous Professional Development (CPD) perspective if deemed not of an academic or professional quality or not to the academic or professional level of the course concerned.

The material displayed on our site and portal is provided for information purposes only without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, and third parties connected to us hereby expressly exclude:

11.1 all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity;

11.2 any liability for loss or damage incurred by any user in connection with the use, inability to use, or results of the use of our website, any websites, social media, or portals linked to it and any material posted on it; and

11.3 any liability for any direct, special, indirect or consequential loss or damage incurred by any user in connection with our website or in connection with the use, inability to use, or results of the use of our website, any websites linked to it and any materials posted on it, including, without limitation any liability for loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, loss of goodwill, wasted management or office time and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even, if foreseeable.

Nothing in this section 8 affects our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation, nor any other liability which cannot be excluded or limited under applicable law.

 

  1. Information About You and Your Visits to Our Website

We process information about you in accordance with our respective policies:  

We use third party service providers who work for us in the provision of our services on the EFS website. Your data may be processed by a third party if required to deliver a service or request feedback on said service you have requested.

 

  1. Viruses, Hacking and Other Offences

You must not misuse our website, social media channels or portal by knowingly introducing viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware. You must not attempt to gain unauthorised access to our website, the server on which our website is stored or any server, computer or database connected to our website. You must not attack our website via a denial- of-service attack or a distributed denial-of service attack.

By breaching this provision, you may commit a criminal offence and we will report any such breach to the relevant law enforcement authorities and we will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our website or portal will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our website or to your downloading of any material posted on it, or on any website linked to it.

 

  1. Restricted Uses

You may use our website only for lawful purposes. You may not use our website or portal:

14.1 in any way that breaches any applicable local, national or international law or regulation;

14.2 in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or 

effect;

14.3 for the purpose of harming or attempting to harm minors in any way.

14.4 to send, knowingly receive, upload, download, use or re-use any material.

14.5 to transmit, or procure the sending of, any unsolicited or unauthorised advertising or 

promotional material or any other form of similar solicitation (spam).

14.6 to transmit any data, send or upload any material that contains viruses, Trojan horses, 

worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

You also agree:

14.7 not to reproduce, duplicate, copy or re-sell any part of our website or content in our portal in contravention of the provisions of these Terms.

14.8 not to access without authority, interfere with, damage or disrupt:

  1. a) any part of our website or portal;
  2. b) any equipment or network on which our website is stored;
  3. c) any software used in the provision of our website; or
  4. d) any equipment or network or software owned or used by any third party.

  1. Indemnity

You agree to indemnify us and keep us indemnified (including our directors, agents, servants and employees) against all losses, costs, charges, demands, proceedings, damages, actions, expenses and claims howsoever incurred by us as a result of your use of this website and portal or a breach by you of any of these Terms.

In the event that your contributions infringe any rights of any third party, you shall, at your own expense and at your discretion, either obtain the right to use such contribution or render such contribution free of any infringement.

 

  1. Linking to Our Website

You may link to our website via the home page only (or as otherwise agreed by us from time to time), provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link from any website that is not owned by you.

Our website must not be framed on any other site, nor may you create a link to any part of our website other than the home page. We reserve the right to withdraw linking permission without notice.

We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

 

  1. Jurisdiction and Applicable Law

The Irish courts will have jurisdiction over any claim arising from, or related to, a visit to our website although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These Terms are governed by Irish law. Nothing in this section 18 will affect your statutory rights as a consumer.

 

  1. Waiver

If we fail to insist upon strict performance of any of our obligations under any of these Terms, or if we fail to exercise any of the rights or remedies to which we are entitled under these Terms, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations. A waiver by us of any default shall not constitute a waiver of any subsequent default. No waiver by us of any of your obligations under these Terms shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

 

  1. Severability

If any of these terms are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

 

  1. Entire Agreement

These terms and any other terms accepted by you in connection with your use of our website and portal represent the entire agreement between you and us in relation to their subject matter and supersede any prior agreement, understanding or arrangement between you and us, whether oral or in writing.

Both you and us acknowledge that neither you nor us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between you and us except as expressly stated in these Terms.
